ESA letters in New York State: use the accommodation notice

Start with the housing documents you already received

If you are preparing an ESA letter in New York for a housing request, look for the accommodation contact in the property’s tenant-rights notice. New York has a state regulation governing notice of tenants' rights to reasonable accommodations. The DHR notice regulation and sample include an animal-related accommodation example and require the notice to identify a contact for receiving requests.

Look in your lease packet, resident portal or messages from the property manager. The useful question is who receives the accommodation request. A general maintenance inbox or rent-payment screen may not reach that person. If you cannot find the notice or contact, ask management to provide them.

Turn the notice into a specific request

The notice tells you about a process; your message explains the change you need. Identify the animal policy that creates the problem and state that you are requesting a disability-related accommodation. Ask how relevant supporting information should be provided.

Example starting message
I am requesting a disability-related accommodation concerning the animal policy at my home. Please confirm the person who will review the request and the appropriate channel for supporting information. I would also appreciate a copy of the accommodation-rights notice if it is available separately from the lease.

Replace general wording with accurate facts about your request. Keep the sent message and reply so that a later reviewer can follow the sequence.

Discuss documentation with the clinician

To discuss an emotional support animal letter in New York, bring the housing question and any request for clarification to your existing clinician. Ask whether they evaluate this issue, what information they need and whether documentation is appropriate within their role. A prewritten certificate does not establish what the professional has assessed.

For telehealth, tell the clinician where you will physically be during the appointment. HHS explains that cross-state practice depends on state-authorized pathways. Living in New York while visiting another state can make location a relevant question; an online appointment does not eliminate it.

New York State and New York City are separate layers

Record the actual municipality and housing type before looking for local help. A provider's advertising phrase such as “New York ESA letter” does not establish which housing rules apply or confirm the clinician assigned to you.

If the response does not address your request

Ask for the stated reason and the specific point that remains unresolved. Separate missing information from a disagreement about the policy or the property's legal coverage. The New York DHR housing-report portal is an official route for reporting a potential discrimination issue.

HUD's withdrawal of older federal guidance does not itself remove New York's notice regulation. It also does not decide a particular case. If you have received a legal notice, obtain timely advice about that document instead of assuming a new letter or agency inquiry stops the deadline.
